I’ve been following US crypto politics since long before it was mainstream. Back in 2013, rumors would spread on the forums that a Senate hearing might finally discuss Bitcoin, and I’d live-stream the whole thing hoping for a single mention. Every single time, not a word on crypto came up, and I’d lost two hours for nothing.

Fast forward to the $TRUMP memecoin era and the meme coin galas I attended in 2024 and 2025, and my name started showing up in mainstream US outlets — CNN, Forbes, Bloomberg, NY Mag, to name a few. Cool stuff, but that’s not why I’m here.

US crypto regulation has moved more in 2026 than in the previous several years combined, even without Congress finishing the job.

Stablecoins Already Have a Law

The GENIUS Act has governed payment stablecoins since it took effect in July 2025, setting 1:1 reserve requirements and banning issuers from paying interest directly. Regulators spent early 2026 finishing the implementing rules: the FDIC proposed requirements for stablecoin issuers in April, and Treasury proposed standards for state-level regimes the same month.

The SEC and CFTC Moved Without Congress

On March 17, 2026, the SEC and CFTC issued joint guidance classifying 16 major tokens, including Bitcoin, Ethereum, Solana, and XRP, as digital commodities rather than securities. That guidance ended years of “regulation by enforcement” uncertainty, though it’s agency policy rather than statute, which means it could shift with a future administration.

The CLARITY Act Is Stuck

The bill that would turn that guidance into permanent law passed the House back in July 2025 and cleared the Senate Banking Committee in May 2026, but it’s been stalled since. The Senate’s August 10 recess deadline came and went without a floor vote, and the odds of passage in 2026 keep sliding. Three disputes remain unresolved: who enforces the bill’s ethics provisions, whether stablecoin rewards survive, and how far protections for software developers extend. Until CLARITY passes, if it does, the March guidance is the closest thing to settled law that US crypto users have.

Canada runs a genuinely different rulebook, and several platforms popular elsewhere in this cluster simply don’t operate there. Binance exited the Canadian market entirely in 2023, and Bybit, OKX, Bitunix, and Blofin all remain off-limits under Canadian securities and FINTRAC rules.
