South Korea’s financial regulators have investigated around 40 cases of suspected crypto market manipulation since the country’s landmark Virtual Asset User Protection Act took effect in July 2024, underscoring the government’s increasingly aggressive approach to policing digital asset markets.

The figures, released by the Financial Services Commission (FSC) to mark the law’s second anniversary, show that authorities have referred more than 30 confirmed cases to investigative agencies for prosecution. The investigations identified 25 suspects during the law’s first two years, reflecting regulators’ efforts to eliminate unfair trading practices and strengthen investor confidence in the country’s cryptocurrency market.

The enforcement update offers one of the clearest pictures yet of how South Korea has implemented one of Asia’s most comprehensive crypto regulatory frameworks, combining specialized investigations, digital forensics, financial penalties, and plans for AI-powered market surveillance.

Virtual Asset User Protection Act Reaches Two-Year Milestone

South Korea enacted the Virtual Asset User Protection Act on July 19, 2024, creating the country’s first dedicated legal framework for protecting cryptocurrency investors and combating market abuse.

The legislation gives regulators greater authority to investigate and punish illegal activities, including price manipulation, insider trading, and other unfair trading practices. It also requires virtual asset service providers to strengthen customer asset protection and internal compliance systems.

To support enforcement, the FSC established a specialized investigation unit dedicated to virtual asset markets. Authorities also expanded digital forensic capabilities and refined the operation of the penalty surcharge system.

These measures enabled regulators to complete roughly 40 investigations during the law’s first two years. More than 30 confirmed cases have already been referred to investigative agencies for criminal proceedings, demonstrating the government’s willingness to pursue serious enforcement actions.

Illegal Gains Reached Billions of Won

The enforcement statistics highlight the significant profits generated through crypto market manipulation.

According to the FSC, the average illicit gain reached approximately 1.4 billion won (about $1 million) per case.

Eight investigations involved illegal profits ranging from 500 million won to 5 billion won, while one case exceeded 5 billion won.

Authorities have also begun imposing substantial financial penalties under the law. In two completed cases, regulators levied penalty surcharges equivalent to 125% to 165% of the offenders’ illicit gains.

The FSC said these penalties are intended to remove financial incentives for market abuse while helping rebuild trust in South Korea’s digital asset ecosystem.

AI to Strengthen Market Surveillance

Although regulators highlighted the law’s early results, they emphasized that enforcement efforts will continue to expand.

In a statement marking the anniversary, the FSC said it plans to increase the use of artificial intelligence to improve the efficiency of market monitoring and investigations.

“Financial authorities plan to keep strengthening efforts to stamp out unfair trading in the virtual asset market, including using AI to improve the efficiency of market surveillance and investigations,” the commission said.

AI-powered surveillance is expected to help regulators detect suspicious trading patterns faster, identify coordinated manipulation across multiple exchanges, and prioritize high-risk cases for investigation.

As crypto markets become increasingly complex and algorithm-driven, regulators worldwide are adopting advanced analytics and machine learning tools to strengthen oversight.

Additional Enforcement Measures Planned

South Korea’s regulatory efforts are set to expand further through a second phase of crypto legislation.

Authorities are considering new powers to suspend financial accounts and linked bank accounts suspected of holding proceeds from unfair trading. Such measures could make it more difficult for offenders to move or conceal illegally obtained assets during investigations.

The government is also reviewing a reporting and reward system that would encourage whistleblowers to report suspected market manipulation and insider trading.

Together with expanded AI-based surveillance, these proposals are intended to strengthen South Korea’s ability to detect, investigate, and prosecute crypto-related financial crimes.

Building a Stronger Crypto Regulatory Framework

South Korea remains one of the world’s most active cryptocurrency markets, with millions of retail investors participating in digital asset trading. In recent years, regulators have sought to balance innovation with stronger consumer protections following several market disruptions and high-profile crypto failures.

The Virtual Asset User Protection Act marked a major step in that strategy by giving authorities dedicated legal tools to oversee the industry. The latest enforcement figures suggest those powers are already being used extensively, with dozens of investigations completed, more than 30 cases referred for prosecution, and meaningful financial penalties imposed.

As authorities prepare additional legislation and expand AI-driven surveillance, South Korea is signaling that strict enforcement will remain central to its strategy for building a safer and more transparent digital asset market.
