Crypto’s Biggest Bill Faces Its First Test

The most important crypto bill in Washington finally gets a floor moment. On Tuesday, September 15 at 2:15 pm ET, the Senate votes on cloture for the motion to proceed to H.R. 3633, better known as the Clarity Act. That mouthful of procedure translates to one simple question: does the Senate even want to debate this thing?

Sixty votes decide it. Nobody in Washington claims to know if they exist. Meanwhile, Polymarket traders have nearly tripled the odds of the bill becoming law this year, and crypto is outperforming stocks on the optimism. Here’s the full picture before the gavel drops.


What Happens on Tuesday

Tuesday’s vote is procedural, not final passage. The Senate decides whether to formally take up the bill and open floor debate. Clearing it requires 60 votes in a chamber Republicans control 53-47, so at least seven Democrats need to cross the aisle. Two Republicans may defect over the stablecoin yield provisions, which would push the required Democratic count higher.

Majority Leader John Thune scheduled the vote just before the August recess, and supporters have treated the date as a deadline ever since. Even a win only starts the clock. Additional procedural votes would follow to end debate, then a final Senate vote, then the House, all before the November 3 midterms compress the calendar into nothing. Miss this window and the fallback is a lame-duck session with even less room.

The Final Offer: 635 Pages, 126 Concessions

Late Sunday night, hours before the vote, Senators Cynthia Lummis, Tim Scott, and John Boozman released a revised 635-page version of the bill. They framed it as their “last, best and final” offer to Democrats, and the text includes 126 substantive changes Democrats requested.

The headline addition is ethics. New language forces federal officials and their spouses to either divest their digital asset holdings or move them into blind trusts. Violations carry civil fines of $500,000 or 20% of the transaction value, whichever is larger. President Trump has reportedly consented to these restrictions, a first for a sitting president and a direct answer to the objection that stalled this bill all year.

Other changes in the final text:

  • A circuit breaker for stablecoin rewards, aimed at bank concerns
  • Narrower liability protections for blockchain developers
  • New registration paths for DeFi protocols
  • Provisions covering credit union authority and spot digital commodity transactions

Treasury Secretary Scott Bessent publicly urged senators to advance the bill, calling it a regulatory and national security priority. The White House has signaled that more concessions could follow if the Senate clears this first hurdle.


Why It Might Still Fail

Three groups stand between the bill and 60 votes.

Democrats remain split on the ethics package. Many argue the language still fails to address the Trump family’s crypto ventures directly, and the divest-or-blind-trust rules arrived less than 48 hours before the vote. Some may support the motion anyway just to keep negotiations alive, since the bill stays open to amendments after this stage.

Banks have lobbied hard against the stablecoin provisions. Their warning: yield-bearing stablecoins could pull deposits out of traditional financial institutions. The circuit breaker in the final text is a nod to them, but the lobbying continued through the weekend.

A couple of Republicans have their own reservations about the stablecoin yield components. Losing them means finding eight or nine Democrats instead of seven, and nobody has published a whip count that gets there.


Polymarket Traders Are Repricing It

The betting money moved before Washington did. Odds of the Clarity Act being signed into law in 2026 sat at a low of 12% at the start of September on Polymarket. They climbed to around 30% as the vote approached, and touched 35% on Monday, the highest reading since late July.

That’s still a two-in-three chance of failure, which sounds about right. Traders are pricing a real shot at progress, not a done deal. The Sunday text release and Trump’s reported sign-off on the ethics rules drove the latest leg up. Watch that market on Tuesday afternoon; it will resolve faster than any news wire.


What It Means for the Market

Crypto is already trading the story. Bitcoin climbed back to $78,000 on Monday while Nasdaq futures fell on calls to slow AI development, and analysts pointed at Clarity Act optimism as the reason crypto sat out the tech selloff.

Keep the macro backdrop in mind before extrapolating. This is a brutal week for risk assets: the Fed, Bank of England, and Bank of Japan all announce rate decisions, and rate-hike odds for the Fed jumped to 86.5% by Monday morning from 69.4% on Friday after hot inflation data and an oil spike. A Clarity Act win could get drowned out by a hawkish Wednesday within 24 hours.

It falls short. The bill isn’t dead, just stuck. Negotiations could continue into the lame-duck session, or the text could resurface inside another bill. Coinbase CEO Brian Armstrong shrugged off both outcomes, noting that regulators would keep building frameworks through rulemaking either way. The SEC’s own chairman disagrees on that point, insisting agency action can’t substitute for actual legislation. Both things can be true: the SEC’s token offering proposal moves forward regardless, and it’s a floor, not a ceiling.

It gets pulled. A postponed vote signals the count wasn’t there, and the bill goes back into the negotiation limbo it has occupied since May.
