Three plaintiffs allege that confidence ultimately led them to download a fraudulent Bitcoin wallet application that stole more than $1.84 million in cryptocurrency, raising fresh questions about where platform responsibility begins when financial scams bypass marketplace safeguards.

How App Store Trust Became the Lawsuit’s Focus

The complaint, filed in the U.S. District Court for the Northern District of California, argues that Apple’s App Store review process gave users confidence that the software had been vetted before becoming publicly available.

According to the plaintiffs, that trust became a key factor in their decision to use the application.

The lawsuit centers on four main allegations:

  • The app impersonated Sparrow Wallet, a well-known Bitcoin wallet with no official iPhone version.
  • Users entered their wallet recovery (seed) phrases after believing the application was legitimate.
  • Apple allegedly failed to remove the app despite earlier warnings that fraudulent Sparrow Wallet copies had appeared on the App Store.
  • The app was reportedly displayed in cryptocurrency-related App Store categories, reinforcing the impression that it was authentic.

According to the filing, plaintiffs James Ramirez, Christopher Ellis and Jalen Delgado collectively lost more than $1.84 million in Bitcoin between May and August 2025. Ramirez alleges losses of approximately $875,000, Ellis about $840,000, and Delgado roughly $120,000.

Rather than focusing solely on the theft itself, the lawsuit argues Apple’s reputation for operating a tightly controlled software marketplace influenced the plaintiffs’ decision to trust the application. The complaint contends that users reasonably believed software distributed through the App Store had undergone meaningful security checks before reaching consumers.

Why Sparrow Wallet Never Had an iPhone App

One of the central factual questions in the case concerns the software the plaintiffs believed they were downloading.

The legitimate Sparrow Wallet, developed by Craig Raw, is a desktop Bitcoin wallet available only for Windows, macOS and Linux. It has never offered an official iPhone application.

Raw had previously warned users about fraudulent Sparrow Wallet applications appearing on Apple’s marketplace and publicly criticized the company for allowing impersonating apps to remain available. Those earlier warnings could become an important part of the litigation because they may help determine whether Apple had notice that users faced an increased risk of fraud before the plaintiffs downloaded the software.

The case also illustrates a broader challenge facing cryptocurrency users. Unlike many traditional financial scams, theft involving recovery phrases is generally irreversible because blockchain transactions cannot be reversed once confirmed. That makes preventing phishing attacks and fake wallet downloads significantly more important than recovering funds after a compromise occurs.

Apple’s Review Process Faces Another Test

Apple has declined to comment on the specific allegations because the litigation remains ongoing, but the company says applications impersonating legitimate software violate App Store policies.

In a statement to MacRumors, Apple said it has removed the fraudulent Sparrow Wallet applications, terminated the associated developer accounts and continues investing heavily in App Store security. The company added that it rejected more than 371,000 app submissions during 2025 for violating its review guidelines, citing those figures as evidence of the scale of its enforcement efforts.

The lawsuit, however, is unlikely to focus on the number of malicious apps Apple blocks. Instead, the central legal question is whether the company exercised reasonable care once an allegedly fraudulent application entered the App Store and whether its review process created expectations of safety that users reasonably relied upon.

The outcome could have implications beyond cryptocurrency wallets. As financial services, digital assets and payment applications become increasingly common on mobile marketplaces, courts may face growing pressure to define how much responsibility platform operators bear when software impersonates legitimate products and users suffer substantial financial losses despite relying on a platform’s security claims.
