Ryder Ridicules Greg, As Bored Ape NFT Case Heats Up In Court

The contentious legal fight between Yuga Labs, the company behind the Bored Ape Yacht Club non-fungible token collection, and digital artist Ryder Ripps and his counterpart artist continues inside court, with Yuga Labs founder accusing Ryder Ripps of IP trademark infringement and cybersquatting. Outside the court matters, Ripps has ridiculed the Bored Ape founder, an act that has somewhat created a sensation on X.

Ripps Mocks Bored Ape NFT Creator Greg

In an August 14 blog post, Ryder Ripps tweeted that “nobody has made more money from my art than Eric Ball, nobody has spent more money on my art than Greg Solano.” In his X tweet, Ripps ridiculed Greg Solana, the founder of the Bored Ape NFT collection, for spending over $30 million on creating his Bored Ape NFT art and spending more than $3 million on top to defend it in court. Eric Ball is known for representing leaders in the blockchain and crypto space, like OpenSea, Coinbase, Polygon, and Yuga Labs, in cutting-edge IP disputes.

Founded in 2021, Yuga Labs is a renowned blockchain technology company, focusing on digital collectibles, metaverse development, and the intersection of technology and creativity. Yuga Labs is home to many non-fungible token collections, including Bored Ape Kennel Club, Mutant Ape Yacht Club, Otherdeed, Koda, HV-MTL, Sewer Pass, and Bored Ape Yacht Club NFT collection. The NFT company was founded by Mr. Greg Solano and Willie Aronow, also known as Gordon Goner.

The Bored Ape Yacht Club founders, through their attorney Eric Ball, filed their first NFT lawsuit against the digital artist and investor Ryder Ripps and his team in early 2023, accusing them of trademark infringement. Yuga Labs accused Ryder Ripps and his team of selling a parallel NFT collection, “RR/BAYC,” that seemed identical to its Bored Ape Yacht Club NFTs. Launched in 2022, RR/BAYC was an NFT collection featuring a limited edition of 10,000 NFTs hosted on the Ethereum network. The NFT collection featured dog skull-themed NFTs, similar to Bored Ape Yacht Club NFTs.

Ryder Ripps And Yuga Labs NFT Case

In July 2023, John F. Walter, the U.S. District Judge of Central California, ruled in Yuga’s favour on its first cause of action for “false designation of origin” and its third lawsuit of action for “cybersquatting.” In his ruling, His Lordship, Walter, ruled that Ryder Ripps and his fellow founder, Cahen, violated the Lanham Act of 1946, which clearly stipulates the primary federal trademark statute in the United States. At the time, Judge Walter maintained that the federal law forbids any trademark infringement, trademark dilution, and false advertising.

In his defence, Ryder Ripps, through his lawyers, maintained that the RR/BAYC NFTs were a form of appropriation art meant not to undermine the original Bored Ape Yacht Club, adding that he created them with alt-right, Neo-Nazi dog whistles and imagery to be a bit different. The judge ruled that the defendants knew that their RR/BAYC NFTs would confuse traders with BAYC NFTs. He awarded Yuga $1.5 million in damages, which later ballooned to more than $8.8 million with attorneys’ fees and other costs.

Last month, the United States Circuit Court of Appeals overturned the initial $8.8 million ruling for Bored Ape Yacht Club non-fungible token maker Yuga Labs in its dispute with artist Ryder Ripps and his business partner Jeremy Cahen over their alleged counterfeits of the NFTs. The Judge said that Yuga Labs had not yet proven its case, sending the case back to the California federal court for a trial on Yuga’s trademark infringement and cybersquatting claims.
