Is Hyperliquid Legal in the US? Trump Says It’s Coming (HYPE +20%)

The last 48 hours have been chaos in my house. Two days ago, my youngest had a playground accident and ended up needing stitches — in her tongue, of all places. I spent the night with her in the emergency room, running on hospital coffee and zero sleep. The next day? No rest for the wicked, because the whole crypto market decided to rip and I was locked in at the screens trading the big pump all day.

She’s fine, by the way. Kids heal fast. Faster than my sleep schedule, anyway.

And just when I thought things would calm down, Trump went and name-dropped Hyperliquid from the White House — which means the question I get asked constantly just became a lot more interesting: is Hyperliquid actually legal in the US?


The short answer

No — not officially, not yet. Hyperliquid has geoblocked US users since launch, and Americans have never had a compliant way to trade on the platform. But that’s exactly what’s about to change: the President of the United States just said, on the record, that the CFTC is working on a legal pathway for American access. No formal proposal exists yet, but this is the strongest signal US traders have ever gotten.

What Trump actually said

During a White House event on Wednesday, Trump said that CFTC Chair Michael Selig is “working to bring Hyperliquid into the United States in a fully compliant and legal fashion.” That’s it. One sentence. No formal proposal, no application on record, no timeline.

Didn’t matter. HYPE was trading around $62 right before the remarks and spiked to a 24-hour high of $72.28 — settling around $70, good for roughly 20% on the day with $1.4 billion in trading volume.

That’s the market we’re in right now: a US President casually mentioning a DeFi protocol by name is enough to add billions in market cap within hours. If you told me this in 2018, when exchanges were getting subpoenas instead of shout-outs, I would have laughed at you.

Why US access is such a big deal

Hyperliquid isn’t some small perps casino. It’s the biggest decentralized perpetuals exchange by a mile, doing around 40% of the entire sector’s volume — roughly $201 billion over the past 30 days. And it built that dominance while being locked out of the deepest pool of retail and institutional traders on the planet.

A compliant path into the American market changes the math completely. More traders means more volume, more volume means more fees, and Hyperliquid’s fees flow into HYPE buybacks. Every new US user is effectively buy pressure on the token.

It would also put Hyperliquid in direct competition with the US incumbents on their home turf — and if you’ve read my Hyperliquid vs Coinbase breakdown, you know how that matchup looks on fees, product depth, and speed. Coinbase’s biggest moat has always been regulatory access, not product. Trump’s comment is a shot straight at that moat.


The options bet that aged suspiciously well

Here’s the spicy part of the story. Hyperliquid Strategies — the Nasdaq-listed HYPE treasury company trading under the ticker PURR (no affiliation with the protocol itself, despite the name) — closed Wednesday up 30.4% at $9.39.

But someone didn’t just get lucky. About four hours before Trump spoke, a buyer dropped roughly $65,000 on 719 PURR call options at an $8 strike, expiring mid-October. By the close, those contracts had nearly tripled, putting the position at around $176,000 — an unrealized gain of about $111,000 in an afternoon.

Options data showed 2,575 of those October $8 calls traded that session, against just 67 contracts of open interest beforehand. That’s over 140x the contract’s 30-day average volume. Nobody can prove the buyer knew anything, and the public data doesn’t identify them. But after 5 million hands of poker, I know what a marked deck looks like. Draw your own conclusions.


Why HYPE is the one coin I never sold

Long-time readers know my position here. HYPE is the only coin I held all the way through the bear. Everything else got trimmed, rotated, or cut — HYPE stayed in the wallet. The fundamentals (real revenue, real buybacks, real users) were simply too good to sell into weakness.

Funnily enough, I placed my first fresh DCA buy right before this pump. Pure luck on the timing — I’m not going to pretend I knew Trump was about to say the magic word. I’ve broken down my whole approach in my HYPE DCA strategy post, and I’m sticking to it: I’ve got limit orders sitting lower, and honestly I’m hoping for a dip in September to fill them. Chasing green candles is how you turn a good position into a bad average.


The pre-IPO angle nobody’s talking about

Here’s what I think gets underrated in all the Trump headlines: Hyperliquid has quietly built one of the most insane features in crypto — the ability to trade pre-IPO exposure to hot private companies from anywhere in the world. Earlier this year it was SpaceX. Right now you can trade the Unitree IPO with crypto — a Chinese robotics company that most retail investors on the planet have zero access to through traditional brokers.

Think about the timing. We’re in a bit of an IPO bull market right now, with hot listings pulling in massive speculative interest. Every trade on these pre-IPO markets generates fees, and those fees flow into HYPE buybacks. More IPO hype (pun fully intended) means more volume, more fees, more buy pressure on the token. It’s a flywheel that works completely independently of whether the CFTC ever delivers on the US access talk.

Don’t sleep on the Season 3 airdrop

And because this is AirdropAlert, the obvious reminder: the Hyperliquid Season 3 airdrop is still open, and everything in this article makes it more interesting. If the CFTC actually delivers a compliant US pathway, the big open question becomes whether American users will qualify for the airdrop too — a wave of fresh US wallets farming points would be the biggest expansion of the eligible pool in Hyperliquid’s history. Nobody can answer that until the legal framework exists, but one thing is certain: wallets already active before any US launch are in the strongest position. Season 1 and 2 rewarded early users generously, and I’d rather be positioned than be reading the recap.


When will Hyperliquid be available in the US?

The honest answer: nobody knows. Neither the CFTC nor Hyperliquid has published anything formal — no proposal, no application on record, no launch window. This pump is running purely on one sentence from Trump. If a real framework materializes, this move will look small in hindsight. If it turns out to be political small talk, expect a retrace.

My take stays simple. Hyperliquid keeps shipping products nobody else has, the buyback flywheel keeps spinning, and US access would pour fuel on both. I’m not chasing this candle, but I’m not selling into it either. Patience got me through the bear with HYPE — I see no reason to abandon it now.

Is Hyperliquid legal in the US? Not officially. Hyperliquid geoblocks US users and there is currently no compliant way for Americans to trade on the platform. However, President Trump stated in August 2026 that the CFTC is working on a legal pathway for US access.

Can Americans use Hyperliquid right now? No. US users are geoblocked from the platform. Some Americans use VPNs to bypass the restriction, but this violates Hyperliquid’s terms and carries regulatory and account risk. There is no compliant option today.
